Driver Charged in OUI Crash that Critically Injured Pedestrian

BOSTON, April 5, 2022— An accused drunk driver was arraigned yesterday in connection with a Downtown Boston crash that left a pedestrian critically injured, District Attorney Kevin Hayden said.

ABANA CABRERA, 36, who is charged under the name ROBERTO RODRIGUEZ CABRERA, was arraigned yesterday in the Central Division of the Boston Municipal Court on charges of operating under the influence of alcohol causing serious bodily injury, OUI alcohol as a second offense, and failure to stop or yield. Assistant District Attorney John Mooney requested a bail of $10,000 and that Cabrera submit to home confinement subject to GPS monitor, refrain from driving, remain alcohol free subject to screenings, and surrender all passports in the event she is to be released on bail. Bail was set at $7,500 and Cabrera was ordered to submit to GPS monitoring, refrain from driving and consuming alcohol, and to surrender any passports.

Cabrera was previously convicted of driving under the influence in Nevada in 2016.

At approximately 12:52 a.m. Monday, Cabrera was operating a Hyundai Elantra in the area of 75 Kneeland Street when she struck the victim as he crossed the street. First responders transported the victim to Tufts Medical Center, where he is being treated for critical injuries.  The defendant allegedly made statements to Boston Police detectives that she had been drinking since 4 p.m. the prior afternoon.  Detectives noted an odor of alcohol from the defendant during the interview.

“Anyone who gets behind the wheel while under the influence of alcohol or drugs has the potential to injure or kill themselves or any other member of our community.  My office is available to the victim and his family as they navigate these terrible events,” District Attorney Hayden said.

Jillian Rose of the DA’s Homicide Unit is the assigned victim witness advocate. Cabrera is represented by Stephen Gomes and returns to court May 6.
